Hemp Law

The hemp industry is undeniably picking up speed across California, Oregon, and Washington, but hemp laws in those states are not always clear. Fortunately, our experienced hemp lawyers are following along with all of the individual state regulations and changes, as well as the USDA’s production regulations. Whether you are new to farming and need guidance on licensing, or have specific questions about hemp laws for your business, our team is here to help.

Hemp, which is legally defined as “any cannabis plant, or derivative thereof, that contains not more than 0.3 percent delta-9 tetrahydrocannabinol (“THC”) on a dry-weight basis,” is being used in a variety of products today. Under Washington, Oregon and California hemp laws, you are required to register as a hemp grower or a hemp handler. There are also many regulations governing not only how you can grow hemp, but how you can use hemp-derived products. This includes everything from how you can grow and handle hemp, to the requirements for utilizing extracts in cosmetics and supplements. For example, a recent Washington bill (S.B. 5372) removed roadblocks for hemp handlers by making it easier to transport products like hemp extract across state lines. We know the ins and outs of these hemp laws and can work with you to ensure that your farm or business is legal and correctly licensed.

Although there’s been plenty of progress in the hemp industry over the last few years, it’s intertwined with complexities within hemp laws across California, Oregon and Washington. The 2018 Farm Bill separated hemp from marijuana and decriminalized it. It also made it possible for other regulatory agencies to regulate the hemp and CBD space, including the Food and Drug Administration (FDA) and the Federal Trade Commission (FTC). Both the FDA and the FTC have cracked down on hemp and CBD marketing claims, including issuance of warning letters and lawsuits aimed at deceptive marketing, which resulted in high dollar settlements. We know these laws and regulations can be overwhelming for a small business, and our hemp regulation attorneys can guide you through your options.
