WSLCB Guidance Regarding Delta-8

By Jordan Gertje on September 14, 2021

The Washington State Liquor and Cannabis Board has formally prohibited the Delta-8 THC dispute, which had been left up to the states to decide. The statement was issued on Wednesday, September 8th, barring producers from converting CBD/hemp into Delta-8 THC, as well as the purchase/sale of Delta-8 THC products produced illegally. Since the 2018 Farm Bill legalized hemp products, several companies have been synthesizing CBD into Delta-8 THC, which is coveted for its euphoric effects, with no governmental oversight and regulations. Delta-8 THC, on the other hand, is an isomer of Delta-9 THC, the psychoactive component in cannabis, raising the question of whether it is a synthetic equivalent of a Schedule 1 controlled substance. Washington becomes the 18th state to regulate and restrict Delta-8 THC, and the matter is currently under review in four additional states. Click here to read the full guidance.
